SaaS Acceptable Use Policy
Notice (Governing language). This document is provided in English. If translated versions are made available for convenience, the English version will govern in case of any conflict, inconsistency, or ambiguity.
This Acceptable Use Policy (AUP) defines the acceptable use of Thinqhub Cloud's Software-as-a-Service (SaaS) solutions and related services. This AUP is an integral part of our SaaS Terms of Service. Any violation of this AUP constitutes a violation of the Terms of Service and may result in immediate suspension or termination of your account.
PROHIBITED ACTIVITIES
1. Illegal Activities
You may not use our Services to engage in, facilitate, or promote any illegal activities, including but not limited to:
- Violation of any applicable local, national, or international laws or regulations
- Fraud, money laundering, or financial crimes
- Distribution of illegal drugs or controlled substances
- Human trafficking or exploitation
- Violation of export control laws or trade sanctions
2. Harmful or Malicious Content
You may not use our Services to:
- Transmit, distribute, or store any material that is harmful, threatening, abusive, harassing, defamatory, or obscene
- Create, distribute, or facilitate malware, viruses, trojans, or other malicious code
- Engage in phishing, spoofing, or other fraudulent activities
- Interfere with or disrupt the Services or infrastructure of Thinqhub Cloud or third parties
3. Intellectual Property Violations
You may not use our Services to:
- Infringe upon any copyright, trademark, patent, trade secret, or other intellectual property rights
- Distribute pirated software, copyrighted content without authorization, or other materials in violation of intellectual property laws
- Reverse engineer, decompile, or disassemble any software provided as part of the Services, except as permitted by applicable open-source licenses
4. System Abuse and Resource Misuse
You may not:
- Attempt to gain unauthorized access to any systems, networks, or data
- Probe, scan, or test the vulnerability of any system or network
- Interfere with or disrupt the Services, servers, or networks connected to the Services
- Use automated systems (bots, scrapers, etc.) to access the Services in a manner that exceeds reasonable use
- Consume excessive system resources that negatively impact other customers or the Services
- Attempt to circumvent security measures, access controls, or usage limitations
5. Data Protection Violations
You may not:
- Process personal data in violation of applicable data protection laws (e.g., GDPR, CCPA)
- Collect, store, or process personal data without proper consent or legal basis
- Share or disclose personal data in violation of privacy laws or agreements
- Use the Services to store or process data in a manner that violates data residency requirements
6. Spam and Unsolicited Communications
You may not use our Services to:
- Send unsolicited bulk messages, spam, or commercial communications
- Send messages that violate anti-spam laws (e.g., CAN-SPAM Act, GDPR)
- Harvest email addresses or other contact information for spamming purposes
- Engage in any form of email spoofing or phishing
7. Prohibited Content
You may not use our Services to store, process, or transmit:
- Child exploitation material or content that exploits minors
- Content that promotes violence, hate speech, or discrimination
- Content that violates human rights or promotes illegal activities
- Content that violates export control laws or trade sanctions
8. Compliance Violations
You may not use our Services in a manner that:
- Violates industry-specific regulations (e.g., HIPAA, PCI-DSS, SOX) without appropriate compliance measures
- Violates export control laws or trade sanctions
- Violates anti-corruption laws (e.g., FCPA, UK Bribery Act)
- Violates any other applicable laws, regulations, or industry standards
RESPONSIBILITIES
Customer Responsibilities
As a customer, you are responsible for:
- Ensuring that your use of the Services complies with all applicable laws and regulations
- Obtaining necessary licenses, consents, and authorizations for data you process through the Services
- Maintaining the security and confidentiality of your account credentials
- Monitoring and managing user access to your account
- Ensuring that your users comply with this AUP
- Backing up your data as appropriate for your business needs
Compliance
You must ensure that your use of the Services complies with:
- All applicable local, national, and international laws
- Industry-specific regulations applicable to your business
- Data protection and privacy laws (e.g., GDPR, CCPA)
- Export control laws and trade sanctions
MONITORING AND ENFORCEMENT
Monitoring
We reserve the right to monitor your use of the Services to ensure compliance with this AUP and our Terms of Service. We may use automated systems and manual review to detect violations.
Reporting Violations
If you become aware of any violation of this AUP, please report it immediately to support@thinqhub.cloud. We take all reports seriously and will investigate promptly.
Enforcement Actions
Upon detection of a violation, we may take one or more of the following actions:
- Issue a warning and request immediate remediation
- Suspend your account temporarily until the violation is resolved
- Terminate your account immediately for serious violations
- Report violations to law enforcement authorities when appropriate
- Pursue legal action to recover damages
No Liability
We assume no liability for any content, data, or activities conducted through your use of the Services. You are solely responsible for ensuring compliance with this AUP and applicable laws.
CHANGES TO THIS POLICY
We reserve the right to modify this AUP at any time. Material changes will be communicated via email or through the Services with at least 30 days' notice. Continued use of the Services after such notice constitutes acceptance of the modified AUP.
